Terms & Conditions – Functional Testing

1. Introduction

These Terms and Conditions (“Terms”) apply to the purchase and use of functional tests, including but not limited to stool tests, offered by Anna Pinnock Nutrition (“we,” “us,” “our”). By purchasing our tests, you agree to comply with these Terms.

2. Eligibility

You must be at least 18 years old to purchase and use our tests. By placing an order, you confirm that you meet this age requirement.

3. Consultations

Our tests are designed to provide you with insights into your health. However, they are not a substitute for medical advice. It is essential to consult with a healthcare professional before making any changes based on test results.

4. Ordering and Payment

4.1 Ordering: To place an order, you must complete the order form and provide accurate information.
4.2 Payment: Payment must be made at the time of order. We accept various payment methods as indicated on our website.
4.3 Pricing: Prices are subject to change without notice. The price applicable at the time of purchase is the final price.

5. Delivery and Sample Collection

5.1 Delivery: Test kits will be dispatched to the address provided at the time of order. Delivery times may vary.
5.2 Sample Collection: Detailed instructions for sample collection will be provided with your test kit. It is your responsibility to follow these instructions carefully to ensure accurate results.
5.3 Return of Samples: You are responsible for returning the samples to our laboratory using the provided packaging and pre-paid return label.

6. Results and Interpretation

6.1 Results: Test results will be available within the timeframe indicated on our website. Results will be sent to the email address provided at the time of order.
6.2 Interpretation: An interpretation consultation is not included in your test purchase. You have an option to purchase a consultation to help you understand your results but it does not replace medical advice.

7. Privacy and Data Protection

We are committed to protecting your privacy. Personal data collected during the ordering process and through test results will be handled in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). We will not share your data with third parties without your consent, except as required by law.

8. Newsletter

By purchasing a test from Anna Pinnock Nutrition, you agree to be automatically added to our mailing list. This subscription allows you to receive updates, promotions, and important information regarding our products and services. If you wish to unsubscribe at any time, you can do so by following the instructions provided in any of our emails or by contacting us. Your privacy is important to us, and we ensure that your information is handled in accordance with our privacy policy.

9. Refunds and Cancellations

9.1 You may cancel your order at any time before a sample collection kit has been dispatched to you and receive a refund.
9.2 Once your testing kit has been dispatched, you have up to 14 days to cancel the order.
9.3 I will inform you if you have to return the testing kit unopened at your cost to the relevant lab.
9.4 If the testing kit you return is complete, unused and undamaged, we will give you a refund minus the postage and card transaction fees. If the returned kit is incomplete, used or damaged in any way, you may incur a cancellation charge of up to £25 (depending on the test) to cover the cost of the kit. This charge will be deducted from the total amount refunded to you, in addition to the postage and card transaction fees.
9.5 We will deduct the cost of any postage fees we incur from the refund should you not cover the cost yourself.
9.6 This cancellation right does not apply if:

You have already had a sample taken at a clinic, laboratory or at home as arranged by us;
You have already sent your sample to the laboratory for analysis;
The 14-day cancellation period has expired.

10. Additional fees

The sample must be returned to the laboratory within a specified time frame. After this period, a replacement kit fee will be applied.

GI MAP: The sample must be returned to the laboratory before the kit’s expiration date, which is printed on the box. A £10 replacement fee applies if a new kit with a valid expiration date is required.
GI 360 stool test and Cyrex Panels: The test kit must be sent to the laboratory before its expiration date. If the kit has an expiry date, it will be displayed on the box or on the blood tube if applicable. Please note that the fee to resend a kit within the UK is £15.
Microbiome Explorer and Gut Zoomer: There are no kit replacement fees or time limits for submitting your sample; however, the sample will be rejected if the kit has expired.
FIT176 and Gut Barrier Panel: An inadequately filled test card means that a re-test is needed, and will come with a re-draw fee of £15.
Urine Iodine: The sample must be sent to the laboratory within 6 months of the purchase date. A kit replacement fee of £25 will be charged if this timeframe is exceeded.

11. Limitation of Liability

Our tests are intended for informational purposes only. We do not accept liability for any loss or damage arising from the use of our tests or the interpretation of test results. Always consult with a healthcare professional before making any health-related decisions based on test results.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or the use of our services will be subject to the exclusive jurisdiction of the courts of England and Wales.
